Royal Enfield is offering a limited number of 120th Anniversary Limited Edition INT 650 or Continental GT 650 motorcycles for customers in USA. By placing an order for the Motorcycle, the customer accepts the following Terms and Conditions (hereinafter “T&Cs”).
TERMS & CONDITIONS
Please read and accept the following Terms and Conditions before participating in the ‘Golden Opportunity’ sale and registering for purchasing the Motorcycles. These Terms and Conditions form a binding legal agreement between you (“Customer”) and Royal Enfield (where “Royal Enfield” would mean Eicher Motors Limited or Royal Enfield North America Limited, depending upon the location of the Customer, as may be determined by Royal Enfield), as of the date Customer accepts these Terms and Conditions by checking the box provided below.
Royal Enfield is offering for sale brand new 120th year limited edition Royal Enfield Int-650 and Continental GT 650 Motorcycles for Customers in the USA. By registering through https://www.royalenfield.com/us/en/120thedition/sale-day/ for purchasing the Motorcycles, the Customer accepts the following Terms and Conditions:
Definitions:
For the purpose of these Terms and Conditions,
(a) ‘Customer’ shall mean a customer who, for the purposes of purchasing a Motorcycle, registers himself/herself on the Website.
(b) ‘Motorcycle’ shall mean one of the 60 numbers of 120th year limited edition Royal Enfield motorcycles, i.e. 30 INT 650 motorcycles and 30 Continental GT motorcycles that can be viewed on https://www.royalenfield.com/us/en/120thedition/sale-day/. Please note that 60 is the total number of motorcycles available in all of USA, the actual number of motorcycles available in each country may vary.
(c) ‘Website’ shall mean https://www.royalenfield.com/us/en/120thedition/sale-day/.
d) ‘Registration Period’ shall mean the period between 1:20 EST (on 1st Sep 2022 and such time till all the Motorcycles are sold out.)
Registration and Sale Process:
(a) Royal Enfield is inviting reservations for brand new 60 units of the 120th year limited edition Royal Enfield Int-650 and Continental GT 650 Motorcycles.
(b) In order to be eligible for purchasing the Motorcycle, Customer shall register himself/herself on https://www.royalenfield.com/us/en/120thedition/sale-day/ during the Registration Period.
(c) Registration/ reservation for Motorcycles shall remain open till stock lasts.
(d) Registration / reservation, as mentioned above, do not require any payment by the Customer (advance or otherwise) towards purchase of the Motorcycles.
(e) Customer must check the applicable on-road price of the Motorcycle before reserving/registering. The price of the Motorcycle applicable for each Customer shall be the relevant on-road price of the Motorcycle in the city/state/country of delivery, as may be chosen by the Customer.
(f) Customer acknowledges that the colors/textures as they appear on the Website may vary from those on actual Motorcycles.
(g) During registration, the Customer will select his/her Country, State and nearest Dealer, so that sale can be accordingly processed and completed.
(h) Upon submission of the registration form, Customer will receive an e-mail communication confirming the status of registration. This e-mail will also confirm whether the Customer falls in the ‘Winners List’ or ‘Reserve List’.
(i) Receipt of registration confirmation e-mail shall not be considered as sale confirmation. Sale shall be considered executed subject to complete payment of the price of Motorcycle to the Royal Enfield dealer of Customer’s chosen country/state and upon fulfilment of other requirements as may be applicable to purchase of Motorcycle in the country chosen by the Customer (during registration).
(j) E-mail communication received by the Customers forming part of the ‘Winners List’ will also stipulate details of the amount payable for the Motorcycle at the selected dealership along with the details of documents required for purchase.
(k) For the Customers forming part of the ‘Reserve List’, the registration confirmation e-mail will mention that they are in the ‘Reserve List’ and shall be offered an opportunity to purchase the Motorcycle in the event of any cancellation by the Customers forming part of the ‘Winners List’.
(l) Customers forming part of the ‘Winners List’ will be given the first opportunity to purchase the Motorcycles and in the event of any cancellation by any of them, Customers in the ‘Reserve List’ will be given the opportunity in the order of their registration.
(m) Customers who form part of the ‘Winners List’ will be contacted by their chosen nearest Royal Enfield dealer, for confirming the reservation and executing the sale.
(n) Customers must respond to the dealer within forty-eight hours of receiving communication, failing which the registration/ reservation shall be considered cancelled.
(o) In the event of any cancellation (due to non-responsiveness or any other reason) by the Customers who form part of the ‘Winners List’, Customers in the ‘Reserve List’ will be contacted by their respective chosen Royal Enfield dealer(s) for confirming the reservation and executing the sale.
(p) Customers contacted by the Royal Enfield dealer(s), pursuant to registration, are required to make the payment for the Motorcycle at such dealership(s) and shall ensure that the same is received / realised by such Royal Enfield dealership.
(q) In case the Customer fails to make the payment for the Motorcycle price within the stipulated time, the reservation shall be deemed cancelled.
(r) On receipt of the price of the Motorcycle, Royal Enfield will make its best endeavour to deliver the Motorcycle to the dealership selected by the Customer within a period of sixty (60) days.
(s) The Customer must submit all the requisite documents to the dealer for registration, insurance etc. at the time of invoicing i.e. at the time of payment of Motorcycle price.
(t) If the Customer fails to provide complete and correct registration details and documents along with the Motorcycle price within the stipulated period, reservation shall be deemed cancelled.
(u) The Motorcycle will be delivered to Customer only on completion of transfer of registration in the name of the Customer.
(v) The relevant dealer shall inform the Customer when the Motorcycle is available for delivery.
(w) All reservations shall be non-transferable.
(x) Only one reservation shall be permitted per Customer.
(y) Each Customer is eligible to reserve a Motorcycle only from the country in which he/she resides, by choosing the relevant country and Motorcycle from the drop-down list available on the Website.
3. Warranty:
(a) The Motorcycle shall have the standard manufacturer’s warranty of three (03) years from the date of purchase.
4. Cancellation Policy:
(a) Customer acknowledges that by registering, a pledge to purchase is made, and Customer will not be eligible to cancel any registration/ reservation made during the Registration Period.
(b) If Customer, at any time after registration/ reservation, cancels such reservation or fails to make payment of the Motorcycle price at the chosen Royal Enfield dealership, the reservation shall be deemed cancelled with immediate effect and Royal Enfield shall be free to sell the Motorcycle to any other customer.
(c) With reference to Clause 2 (r) above, if Royal Enfield dealer fails to deliver the Motorcycle within the stipulated time period, the reservation shall be deemed cancelled and Royal Enfield dealer’s sole liability towards the Customer shall be to refund the amount received from the Customer towards purchase of Motorcycle.
(d) Customer will not be eligible to cancel a reservation once the full price of the Motorcycle has been paid.
5. Miscellaneous:
(a) Any query or complaint with respect to the details mentioned above may be referred to Royal Enfield at usmarketing@royalenfield.com.
(b) These Terms and Conditions and any disputes arising out of the same shall be governed by the law of the State of Wisconsin, USA. The courts in Wisconsin will have jurisdiction to adjudicate any dispute relating to the foregoing.
