AGREEMENT (HEREINAFTER REFERRED TO AS “EULA”) CAREFULLY BEFORE
REGISTERING OR USING “ROYAL ENFIELD” MOBILE APPLICATION SERVICES.
This EULA forms a binding legal agreement between you (“You” or
“Your”) and Eicher Motors Limited, known by its brand name Royal
Enfield (each separately a “Party” and collectively the “Parties”)
as of the date You download the Mobile App (defined hereinafter).
This EULA shall apply to Your use of the Royal Enfield mobile
application and services (“Mobile App”) provided by Eicher Motors
Limited (hereinafter referred to as “EML”, “Royal Enfield” or
“RE”).
This EULA forms a binding legal agreement between you (“You” or
“Your”) and Eicher Motors Limited, known by its brand name Royal

TERMS & CONDITIONS
Please read and accept the following Terms and Conditions before booking a slot for availing services under the Factory Custom Program. These Terms and Conditions form an electronic record under the provisions of the Information Technology Act, 2000 (“Act“), and rules made thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008. These Terms and Conditions are computer-generated and do not need any physical or digital signatures.
These Terms and Conditions form a binding legal agreement between you (“Customer”/”You”) and Eicher Motors Limited (known by its brand name Royal Enfield), as of the date You accept these Terms and Conditions by checking the box at the bottom of the Website page and submitting the form provided there.
If You do not agree with any of the terms set out herein, do not book the slot for availing services under the Factory Custom Program.
By submitting the form available at https://www.royalenfield.com/in/en/home for booking a slot, You confirm to have read, understood and accepted the following Terms & Conditions:
1. Definitions
For the purpose of these Terms and Conditions,
‘Customer’ shall mean a customer who, for the purposes of availing the services under the Factory Custom Program, registers himself/herself on the Website and successfully books a slot for the same;
‘Factory Custom Program’ shall mean the Motorcycles customisation services provided by Royal Enfield, subject to these Terms and Conditions;
‘Motorcycle’ shall mean the Royal Enfield Classic 350 models.
‘Slot Booking’ shall mean the online booking of limited slots for availing services under the Factory Custom Program, scheduled to be held every month till the slots last;
‘Slot Booking Period’ shall mean the period each month when the website shall be open to customers for booking their slot under the Factory Custom Program;
2. Scope of Services under Factory Custom Program; Slot Booking; Eligibility Criteria
The Slot Booking is open to all the residents of India, who are aged 18 or above. Employees of Eicher Motors Limited and its affiliates, subsidiaries, and their immediate families are not eligible to participate.
Only Customers who have booked the Motorcycle under Factory Custom Booking on the website _____________, will be eligible for Slot Booking.
Services under the Factory Custom Program will be provided to limited Customers who successfully book a slot on the Slot Booking Period, upon payment of the appointment booking fee of INR 5000/-.
Slot Booking under Factory Custom Program shall conclude as soon as limited slots for the month are successfully booked.
Upon submission of the slot booking form, Customer will receive an e-mail communication confirming the status of booking.
Any amount received by Royal Enfield after all the available appointment booking slots are booked, will be refunded to the respective customers, by crediting the same back to the payment source.
Services under the Factory Custom Program will be provided by Royal Enfield only with respect to the Royal Enfield Classic 350 Motorcycle, provided Customer fulfils the eligibility criteria.
Services under the Factory Custom Program will be limited to cosmetic (paints/decals/badges/seat rexines/threads and genuine motorcycle accessories i.e. GMA) alterations only, within the options and guidelines provided by the Royal Enfield team. All the engineering/feature/mechanical/electrical parts of the Motorcycle will remain ‘as is’.
Customer acknowledges that the colors/textures as they appear at the time of design finalisation/sign-off may vary from those on actual Motorcycles.
3. Fees
Customer shall pay an appointment booking fee of INR 5,000/- (INR Five Thousand only) at the time of Slot Booking on the Website.
Customer shall pay INR 15,000/- (INR Fifteen Thousand only) at the time of conclusion of discussion with Royal Enfield design team and finalisation of the design and specification for their motorcycle.
Once customer has signed on the design spec sheet and paid the vehicle booking sum of Rs 20,000/- (comprising of INR 5000/- appointment fees and INR 15000/- payable for Factory Custom design/pattern finalization), it is non-refundable.
The currency for payment shall be INR (Indian Rupee) only.
4. Factory Custom Program
Enrolment in the factory custom program is not open to existing bookings or already owned motorcycles.
The appointment will be a physical meeting at the factory custom design studio at Royal Enfield’s Thiruvottiyur factory. Customer shall make his/her own arrangement for travel, boarding and lodging and shall have to be present at the confirmed date and time selected/agreed with RE representative.
In case subsequent appointments are required by the Customer to finalise the designs, the same shall be confirmed by Royal Enfield, at its sole discretion, subject to its design team’s and Customer’s availability. Maximum of 1 additional appointment (total 2) can be arranged for each customer.
From the date of booking appointment on the website, Customer shall have to schedule their physical meeting at the factory custom design studio at Royal Enfield’s Thiruvottiyur factory and conclude the design and specification finalization process within a maximum period of 30 days (including additional appointment, if any). EML shall refund the appointment booking amount of INR 5000/- to any Customer who fails to conclude the design and specification finalization process within 30 days.
On the appointment date, Royal Enfield design team will discuss the customisation requirements with the Customer and finalise the custom designs and specifications subject to Clause 2(h) above.
To confirm the Motorcycle booking under Factor Custom Program, Customer has to sign on the final design specification sheet and make payment of INR 15000/-.
Customer acknowledges and agrees that any such subsequent appointment will be as per the aforementioned provisions, subject to Royal Enfield design team’s availability. The Customer’s visit to the Royal Enfield premises for finalisation of the designs shall be done at Customer’s sole risk and expense.
5. Delivery; Warranty
Customers contacted by the Royal Enfield or its authorised dealer(s), pursuant to design finalisation, are required to make the payment for the Motorcycle at such dealership(s)/company owned store, and shall ensure that the same is received / realised by such Royal Enfield store or dealership.
In case the Customer fails to make the full and final payment for the Motorcycle price within the stipulated time, the booking shall be deemed cancelled, without any obligation on Royal Enfield and the booking amount of INR 20,000/- shall become non-refundable.
Royal Enfield will make its best endeavour to deliver the Motorcycle to the dealership/company owned store selected by the Customer within a period of 120 days from the date of finalisation of booking by making payment of INR 15000/- post sign-off of the factory custom Motorcycle specification sheet, subject to realisation of full and final payment of the Motorcycle.
The Customer must submit all the requisite documents to Royal Enfield or its authorised dealer, as the case may be, for registration, insurance etc. at the time of invoicing i.e. at the time of payment of Motorcycle price.
If the Customer fails to provide complete and correct registration details and documents along with the Motorcycle price within the stipulated period, reservation shall be deemed cancelled.
The Motorcycle will be delivered to Customer only on completion of transfer of registration in the name of the Customer.
The relevant Royal Enfield store or its authorised dealer, as the case may be, shall inform the Customer when the Motorcycle is available for delivery.
All bookings shall be non-transferable.
The personalised/customised Motorcycle, once delivered, will carry the standard manufacturer’s warranty of three (03) years from the date of purchase or 30,000 Kms, whichever is earlier.
Customised parts are made to order. Therefore, in case of parts warranty claim by a Customer with respect to the customised parts of the Motorcycle, an order will need to be placed with chosen dealership for replacement and best efforts shall be made to provide the part within a period of ninety (90) days.
In case of parts warranty claim by a Customer pertaining to mechanical /electrical /technical features that form part of the standard manufacturer’s warranty applicable to the Motorcycle, the replacement can be made and serviced at the nearest dealership subject to availability of the said part in stock at that dealership.
6. Cancellation Policy
Subject to Clause 6(b) below, a Customer may cancel the slot booked under the Factory Custom Program, at any time, by writing an email to support@royalenfield.com
Upon cancellation of an appointment slot, INR 5000/- shall be refundable.
Customer shall not be eligible to obtain any refund of either the slot booking fee of INR 5000/- or INR 15,000/- paid upon finalization of design specification sheet. Both of these fees amounting to INR 20,000/- shall be non-refundable i.
If the Customer, at any time after booking a slot under the Factory Custom Program, cancels such booking or fails to make payment of the full Motorcycle price at the chosen Royal Enfield dealership/company-owned store, as the case may be, the slot booking shall be deemed cancelled with immediate effect and Royal Enfield shall have the legal right to sell the Motorcycle to any other customer.
With reference to Clause`5 (c) above, if Royal Enfield or its authorised dealer fails to deliver the Motorcycle within the stipulated time period, the booking shall be deemed cancelled and Royal Enfield or its authorised dealer’s sole liability towards the Customer shall be to refund the amount received from the Customer towards purchase of the Motorcycle.
Customer will not be eligible to cancel a booking once the full price of the Motorcycle has been paid.
7. Miscellaneous
Royal Enfield reserves the right to amend these Terms and Conditions at its discretion without prior notice.
Royal Enfield will process Your personal data or personally identifiable information, that it collects, in accordance with its data Privacy Policy and applicable laws. For the purposes of these Terms and Conditions, any reference in the Privacy Policy to Royal Enfield’s website or any other page shall include a reference to the Slot Booking/ registration page and all the related platforms, servers, etc.
These Terms and Conditions and any disputes arising out of the same shall be governed by the law of India. The courts in Chennai will have exclusive jurisdiction to adjudicate any dispute relating to the foregoing.
