1. Eicher Motors Limited (“EML/ Royal Enfield”) is organising the #BulletMeriJaan contest (“Contest”) wherein participants will compete with each other, as per the terms of the Contest, before the final winners are chosen from amongst them.
2. The Contest will open on Instagram through an announcement on Instagram Stories on 19th August 2023 at 2PM IST.
3. The Contest is open to all those people who are residents of India, have a public social media account and are in possession of a valid permanent driving license at the time of entry. Business associates of Royal Enfield, parties involved in the development or execution of this Contest, or in production or distribution of Contest materials, their affiliates, and their respective employees and associates shall not be eligible to participate. All the participants must follow Royal Enfield across social media platforms.
4. The Contest involves posting pictures or videos of/with Royal Enfield Bullet motorcycle on the participant’s Instagram page. To participate in the Contest, you need to post pictures or videos of/with Royal Enfield Bullet motorcycle, within the Contest timelines, by following the below-mentioned steps:
• Post picture/video of/with Bullet on social media.
• Tag @royalenfield Instagram handle and use #RoyalEnfield #BulletMeriJaan in the caption.
• Once the Contest is live, the posts will also feature on Royal Enfield #BulletMeriJaan website page.
5. By submitting the post on the social media platforms, you agree to participate in the Contest, and further, that you have read and understood these terms and conditions and agree to be bound by the same.
6. You acknowledge and agree as follows:
(i) that Royal Enfield shall, at its sole discretion, be free to choose the winners of the Contest based on the content/entries submitted by them;
(ii) that Royal Enfield reserves the right to remove your entry or submission if it does not conform with these terms and conditions;
(iii) that posts/entries which are offensive, inappropriate, or plagiarized or those containing profanities will be disqualified;
(iv) that Royal Enfield is not under any obligation to accept entries which are incomplete, delayed, corrupted, damaged, wrongly delivered or not received for whatsoever reason;
(v) that you will not use multiple social media handles to make entries or publish posts;
(vi) that this is a free Contest and no entry fee is charged for participation, nor does it require you to buy any Royal Enfield product, promotional or otherwise, or pay any charges to Royal Enfield for collecting the prize;
(vii) that top fifty (50) posts/entries (static/reel/video) that adhere to these terms and conditions, and get the maximum number of likes, will be announced as winners of the Contest by Royal Enfield and such winners shall be intimated/contacted via e-mail or direct message on their respective social media handles within 36 hours from closing of the Contest;
(viii) that each of these fifty (50) top posts/entries/winners will receive a gift hamper containing Bullet 350 merchandise;
(xi) that, if chosen a winner, you will be required to provide your valid identity proof at the time of collecting the prize and failure to do so may result in prize entitlement being withdrawn;
(x) that, if you, after being chosen as one of the winners, cannot be contacted for any reason, or you do not confirm your willingness to receive the prize, you shall be treated as having forfeited the prize, and Royal Enfield also reserves the right, but is not obligated to award the prize to any other entry picked at the same time as the original. The back-up winner is also subject to the same conditions as the original winner;
(xi) that as a condition to participate in the Contest, you, if chosen as one of the winners, will be required to take part in post-promotion publicity, without any remuneration or compensation of any kind;
(xii) that the prizes are non-transferable and non-refundable. Royal Enfield reserves the right to substitute either any part of prize or whole prize for similar or such other prize as may be deemed fit by Royal Enfield;
(xiii) that you provide your express consent to Royal Enfield and its representatives for using your name, contact details and other details, as may be provided by you, for promotional purposes across media and also to be approached by Royal Enfield for purposes as may be reasonably related hereto; and that Royal Enfield will use your personal data in accordance with its Privacy Policy.
7. By sharing/submitting the posts/entries for participating in the Contest, you grant Royal Enfield royalty-free, transferable, sub-licensable, perpetual, irrevocable and worldwide right and license to use, display, modify, transmit and reproduce the entry submitted by you, in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, and Royal Enfield shall be free to use and exploit the same for any purpose it deems fit, including without limitation, for marketing, promotion and commercial gains. You agree that, if requested, you will sign additional documentation that may be required for Royal Enfield to exercise the rights/licenses granted here. You further agree that Royal Enfield is under no obligation to pay you any consideration, whether monetary or otherwise, for the license granted herein.
8. You represent and warrant that the entry, submitted and licensed by you to Royal Enfield,:
(i) is your own original work and you have necessary rights and licenses to use, sub-license and allow usage of the same for commercial, promotional, marketing and all other purposes;
(ii) does not contain any illegal content or material;
(iii) does not contain or reference any third party’s name, trademark, intellectual property, content, designs or any other material;
(iv) does not infringe or otherwise violate the copyright, trademark, trade secret, privacy or any intellectual property or other rights of any third party; and
(v) is free from viruses and other malware.
9. You irrevocably waive, to the extent permissible by law, any "moral rights" or other rights with respect to attribution of authorship or integrity of materials regarding each item of the post/entry that you submit.
10. Further, you undertake to defend, indemnify and hold Royal Enfield, its affiliates, and their respective officers, directors, employees, and agents harmless from and against any claim, loss, damage, settlement, cost, expense or other liability (including attorney’s fees) that arises, directly or indirectly, (each a “Claim”) from (i) violation of any third party rights including intellectual property rights arising from or in connection with your entry, or use thereof by Royal Enfield; and/or (ii) your breach or non-compliance with any representation, warranty or other obligations under these terms and conditions.
11. Royal Enfield and its related companies and agencies will not be liable for any loss (including, without limitation, direct, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Contest or the acceptance or use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
12. Royal Enfield reserves the right to amend these terms and conditions at its discretion without prior notice. Further, Royal Enfield may, at its sole discretion cancel or postpone the Contest for any reason beyond its control, without any liability to any entrants or third parties.
13. These terms and conditions shall be governed in accordance with the laws of India and any dispute(s) pertaining to this Contest and these terms and conditions shall be subject to jurisdiction of courts in Chennai.
